These terms and conditions apply to all buyers and all sellers. The Dutch version is binding, all translations are purely informative.
By participating in the auction, the buyer and seller confirm that they have consulted, know and accept the auction conditions.
Dressage Horse Auction BV organizes live and online auctions for dressage and jumping horses, in collaboration with a notary or bailiff who will, among other things, monitor the correct conduct of the auctions and allocate the horses.
• At live auctions, bidding can be done from the room or remotely.
• Online auctions only allow online bidding.
The auctions are organized using the auction website www.dressagehorse.auction.
Buyers:
• Buyers must register in advance on the website and make their identity known before they can place online bids at live or online auctions.
• For live bids in the calling room, the identity of the highest bidder is checked by the notary or bailiff.
Sellers:
• The sellers reveal their identity when registering the horse.
The Auctions:
• We organize auctions for horses in two disciplines, namely dressage and jumping.
• To determine the age of a horse, it is accepted that each horse turns one year older on January 1, so a horse born on May 20, 2025 will turn one year old on January 1, 2026.
• We can include the following horses in our auctions:
• Foals that are at least three months old at the start of the bidding and are bred in dressage or jumping.
• Young horses and horses that belong to the sport of dressage or jumping.
Who have passed our selection procedure.
Registration and selection:
As an auction organization, we make a selection and assess the horses based on:
• their ancestry
• their qualities as a sport horse or breeding animal
• their health
• the expectations in our auction.
The selection for the auction takes place in four phases. By registering, the seller undertakes to offer the horse for all phases of the selection, and subsequently at the auction, provided that the horse remains accepted by the auction organization after each phase. The auction organization never gives the reason why a horse is not selected, not even to the seller, nor to third parties.
1. Registration and first selection:
When registering for the selection, the seller pays 200 euros registration fee + VAT. The registration must include a copy of the horse's passport, its pedigree, its own performance, the performance of relatives, photos and film material, height at the withers, color, sport direction, and all useful information about the horse.
The seller specifies the minimum amount for sale. This amount is not published.
The seller also provides and his details, a copy of his own identity document, where applicable the published articles of association of the company and the identity document of the director.
The organization selects the first time.
2. Second assessment:
After an initial selection based on the information provided when registering, the auction organization prefers to visit the seller by appointment to assess the horse. This can be replaced at the initiative of the auction organization by photo and film material supplied by the seller. A reason for not going on site may be the distance between the auction organization and the seller.
3. Medical examination:
If the horse has completed a positive trajectory until then, the full medical examination will be carried out as requested.
A medical examination with a report no later than two weeks before registration is a condition for participating in the auction.
If the medical report is older, it is sufficient to have the veterinarian confirm that the medical condition has remained unchanged. The vet confirms with the date and signature on the original medical report.
Horses younger than 2 years old only need to submit a health certificate drawn up by the veterinarian. From 2 years of age, there are an additional 16 X-ray images, in which the forefeet, fetlocks, jumps and knees are imaged. The radiographs must be interpreted in the light of the entire horse. The purpose of use, age, possible sports career and the findings during the clinical examination are important.
The auction organization determines which horses remain in the running for safety. The full medical report is available for inspection during the viewing.
4. The seller will provide photos and film material of the accepted horses for publication on the auction website. The auction organization may take photos and film material for use on the website at any time, and decide which to publish.
The accepted horses are listed in the online catalog in a random order.
Original passport and other necessary documents:
• Copies of the horse's documents will be accepted at registration and during selections.
• Before the start of the life auction, all original documents must be at the secretariat. Failure to deliver the originals or to deliver them on time is equivalent to not offering the horse at auction.
• For online auctions, the original documents must be shown when the horse is presented to the representative of the auction organization. Copies of the documents will be provided. All original documents remain with the horse.
The law:
Public auction legislation applies. This includes:
• The auction takes place under the direction and/or supervision of a notary or bailiff.
• The horses can be viewed in advance. Consequently, the buyer is deemed to have been fully, personally and under his own responsibility informed about the condition of the horses.
• The horses are auctioned in the same order as they are listed in the catalogue. The auctioneer may deviate from this without having to give a reason.
• The bids are by auction, with increases as stated below.
• The notary or bailiff allocates the horse to the highest accepted bid.
Viewing:
The seller allows the horses to be viewed in advance:
• For live auctions starting from 6 p.m. or later:
in the stables near the auction hall on the day of the auction from 2 p.m. to two hours before the start of the auction.
• For live auctions starting at 3 p.m.:
in the stables near the auction hall on the day of the auction from 10 a.m. to 1 p.m.
• For online auctions:
at the stable address during two consecutive Saturdays from 2 p.m. to 6 p.m. Unless otherwise stated, the last two Saturdays prior to the closing of the bids. The stable address is stated on the auction organization's website.
Sales:
The horses are used for a starting amount chosen by the auction organization in consultation with the seller.
The starting amount will usually be between half and 2/3 of the expected sales price. The starting amount is always a multiple of 500.00 euros.
• For life auctions:
If there is no interest in the horse for the starting amount, it will not be sold in the first performance.
If the highest bid in the first presentation is lower than the expected sales price, the seller may decide not to allocate the horse and present it a second time the same day after all horses have been presented the first time.
If the expected sales price is achieved in the first performance, the horse can no longer be presented in the second performance.
If a horse appears in the second performance, the starting amount will be reduced to 2/3 of the original starting amount, with a minimum multiple of 500 euros. Bidding in the second performance can never start lower than the highest bid in the first performance.
It is sometimes better to start with a low starting amount to arouse interest in the horse.
• For online auctions:
If there is no interest in the horse up to 24 hours before closing the bids, the starting amount will be reduced to 2/3rds of the original starting amount, with a minimum of 500 euros or a multiple thereof.
The bids:
Increase the bids by the following amounts per bid submitted:
• The first bid is equal to the starting amount.
• Up to €5,000 the increase is €100 per bid.
• From €5,001 the increase is €250 per bid.
• From €10,001 the increase is €500 per bid.
• From €20,001 the increase is €1,000 per bid.
• From €50,001 the increase is €2,500 per bid.
• From €100,001 the increase is €5,000 per bid.
• Above €250,001 the increase is €10,000 per bid.
In life auctions, the auctioneer can deviate from this and reduce the increase to a lower level.
The bids are always without VAT. The amount of allocation is subject to VAT regulations if the seller is liable for VAT.
Until the close of the bidding, each bidder remains bound by his bid and after the closing of the bidding, the five highest bidders remain bound until either the allocation or the withdrawal of the horse from the auction.
The five highest bids are binding for ten days after the closing of the bids. The allocation or non-allocation of the horse will take place within ten days. The seller reserves the right to accept or reject the offer. The allocation can only be completed when the seller has accepted the offered price, both in a life auction and an online auction.
In life auctions, bidding is done by show of hands.
The seller can decide not to proceed with the sale until just before the horse is allocated and withdraw the horse from the auction. Once assigned, the sale is final.
Until the close of the bidding, each bidder remains bound by his bid and after the closing of the bidding, the five highest bidders remain bound until either the allocation or the withdrawal of the horse.
In online auctions, bidding takes place exclusively online via the platform offered.
If a bid is placed in the last ten minutes before the initially set end time, the end time will be extended by ten minutes. If another bid is made in these last ten minutes, the period within which a bid can be made will be extended again by ten minutes. This process will end at midnight at the latest.
Anyone who makes a valid bid during a public auction is expected to be able to maintain this bid and to bear the consequences of the purchase.
The buyer purchases the goods as they are, without warranty, without right of withdrawal or buyer's purchase.
Responsibility is transferred to the buyer upon assignment, the buyer enjoys it from delivery.
The expected sales price:
The seller can indicate an expected sales price when registering for the selection.
This expected sales price is important for:
• The selection and tradability at our auction.
• Whether or not to allocate at life auctions.
• Any commission in the event of non-allocation.
If the seller does not indicate an expected sales price, it is accepted that any bid received is greater than the expected sales price.
Assigning:
Only the notary or bailiff can assign a horse. The auctioneer can receive the bids and allocate them provisionally.
For the assignment, the notary or bailiff must be able to determine the identity of the buyer. The auction organization, the notary or bailiff can therefore always request a copy of the identity document of each bidder.
In the context of a sale, the notary or bailiff may refuse persons who are unknown to him or whose identity or fitness has not been proven, or whose person is not solvent. The notary or bailiff can refuse bids from people who are apparently under the influence of alcohol, drugs or other narcotics. The notary or bailiff can then fall back on the second highest bidder. If the notary or bailiff refuses an offer, he does not have to draw up a substantiated report.
The horse will be allocated to the highest accepted bid when the seller has accepted the offered price.
The notary or bailiff draws up and signs the deed of assignment.
• In a life auction:
After the bids have expired, the notary or bailiff assigns the highest accepted bid to the highest accepted bid, after acceptance of the bid by the seller.
In the presence of the seller, he immediately accepts the highest acceptable offer or rejects it.
In his absence, the seller gives the organization the authority to accept the offer on his behalf when the expected sales price has been achieved. If the expected sales price is not achieved, he authorizes the organization not to accept the offer on behalf of the seller.
• For online auctions:
Up to 72 hours after the bidding has closed, the seller can inform the auction organization by email to info@dressagehorse.auction or info@jumpinghorse.auction that he does NOT agree to the sale at the highest bid. If he does not report or does not report in a timely manner that he does not agree to the sale, he is deemed to have agreed to the sale.
The Commision:
If a horse is not allocated for the expected sales price, the seller does not owe any commission.
If the highest bid is equal to the expected sales price or higher and the seller does not allow the horse to be allocated, the seller is liable to pay compensation equal to the commission that he would normally have owed, plus the amount that the buyer would normally have owed. paid auction costs.
The registration fee, commission, auction costs and compensation are owed to the organization. These amounts are subject to VAT regulations.
• The seller pays the following commission to the auction organization, calculated on the amount of the allocation:
• 4% commission on life auctions,
• 2% on online auctions.
The committee is subject to VAT regulations.
• The buyer pays 10% auction costs on the allotment amount. The auction costs are subject to VAT regulations.

The auction organization may set off debts and thus settle the balance between the claim and the debt.
The auction organization receives the funds without charging costs or paying interest.
Miscellaneous:
• In the event of uncertainty or disagreement before, during or after an auction, of whatever nature, regardless of which parties, the notary or bailiff will be asked to make a decision as an independent person. This decision is final.
• From the time the horse is allocated until it is collected, the seller takes good care of the horse.
• All bids and payments are made in Euro. All monetary amounts, from both buyer and seller, are due immediately upon assignment, or upon withdrawal from the auction or sale.
• VAT will always be charged on the settlement, except on the allocation amount if the seller is not liable for VAT. In the case of export, this is a provisional charge to secure this amount. In the event of export of the horse, the buyer will submit a valid export document to the organization within 14 days after delivery, on penalty of final VAT being charged.
• Neither the seller nor the buyer can derive any rights from the fact that the auction organization has selected the horses and, if necessary, were subjected to a veterinary examination at its request.
• The information regarding the horses is only intended to give an impression of the qualities of the horses, without pretending to be complete and without giving any guarantees. When describing the horse, the organization depends on the information provided by a seller or third parties. The organization is not liable for any printing errors and/or material errors on its website, online and printed catalogue.
• The organization is not a party to the purchase/sale relationship of auctioned horses. The organization only acts as an auction service between the seller and the buyer of the horse. The organization, preparation and execution of the auction are determined solely by the organization. This means, among other things, that the organization determines the course of events prior to and during the auction and has the authority not to auction one or more horses or not to recognize a bid and declare it invalid, to suspend or resume the auction. , extend or cancel and/or take other measures it deems necessary.
• The invoicing through the organization does not give reason to be a party to the sales and purchasing process.
• Payment by the buyer must in all cases be credited to the organization's account, unless it is indicated that the funds must be credited to the third-party account of the subsequent notary (or bailiff). Payments must be received no later than ten days after allocation. In case of late payment, the organization charges 25 euros per day of delay, with a minimum of 500 euros plus 21% VAT.
• At the request of the seller, the notary or bailiff, in consultation with the auction organization, is authorized to cancel a sale.

• The cancellation of a sale/purchase is established by the notary or bailiff involved in an additional report.
• If payment has not been received on the specified account within the specified period, the seller is free to initiate a collection procedure against the buyer. The costs associated with the collection procedure are advanced by the seller and are fully borne by the buyer.
• Participation in the selections and the auction are entirely the responsibility of the seller. He declares that he has taken out liability insurance for damage to third parties.
• In the event of damage that may involve the auction organization's liability, of whatever nature, the buyer and seller will in any case indemnify the auction organization against all damage in an amount higher than the registration fee.
• Animal health:
The location of the life auction falls within a protective zone for animal health reasons, which means that no collections and/or transports of horses are possible or permitted.
The auction is converted to an online auction. The organization mentions this on its website and notifies participating sellers.
Health certificate:
The presence of a health certificate is mandatory for the intra-Community movement of horses. It is therefore possible that a health certificate is required for the life auction, and a health certificate for the delivery of the horse.

The seller will ensure, at his own expense, that the health certificate - if necessary - is present for transport to and from the auction location for life auctions. If a health certificate cannot be obtained, the owner will inform the organization, stating the reason on a report from the veterinarian who refuses to issue the health certificate.
If a health certificate cannot be obtained for participation in a life auction, a message will be sent that the horse in question is not present.
Only if the seller's company falls within a protective circle that prevents horse transport to the auction, this will be considered force majeure and the seller will not be liable for any compensation.

• Before picking up the horse, the buyer asks the seller to provide the health certificate if a health certificate is required. This health certificate is at the buyer's expense.
• If no health certificate can be obtained for delivery within three months after allocation, the buyer can request that the purchase be canceled due to non-delivery of the horse. The normal commission owed by the seller remains unchanged. The auction costs owed by the buyer will be borne by the seller. Only if the seller's company is continuously in a protective circle during these three months, which prevents horses from being transported or exported, will this be considered force majeure and no commission is due.
• The seller cannot charge additional stable costs if the delay in delivery is caused by failure to obtain the necessary health certificate for the horse.
• Animal welfare:
o The seller and buyer comply with animal welfare legislation.
• The delivery of the horse:
o The buyer collects the horse from the seller within 14 days after the allocation, after he has made full payment into the account of the auction organization (or the third-party account of the subsequent notary or bailiff if this is stated).
o The organization notifies the buyer and seller that the payment has been received and the horse can be picked up.
o The buyer determines in consultation with the seller the day and time that he will pick up the horse.
o If the horse is not collected during these 14 days, the seller may charge the buyer a stable fee of €25 per day from the 15th day after the allocation. This settlement is made directly between the seller and the buyer.
o Foals generally remain with their mother until they are five months old. If a foal is younger than five months on the day of allocation, the collection period starts on the day the foal reaches the age of five months. The buyer can decide to collect the foal at a younger age, although the foal may not be younger than four months at the time of collection.
Conditions only valid for a forced public sale:
The conditions valid for this form of public sale will be announced when the auction is made public.
This way, the horses can be sold without a medical inspection.
The information on the posters, in the announcements and on the sales website is purely informative. The horses were on display. Consequently, the buyer is deemed to have been fully, personally and under his own responsibility informed about the condition of the horses.
The bailiff will monitor the auction, assist and allocate the animals.
Dressage Horse Auction's compensation is recorded in advance in a contract with the selling bailiff.
Generalities:
Any dispute arising from this auction and its consequences is governed exclusively by Belgian law, with the exclusion of the provisions of the Vienna Sales Convention on international purchases and sales. In particular, legislation applies to public auctions, including consumer law.
In the event of uncertainty or disagreement before, during or after an auction, of any nature, regardless of which parties, the parties involved will ask the notary or bailiff to make a decision as an independent person. The decision taken by the notary/bailiff is final and binding on the parties drawn.
The courts that have jurisdiction at the registered office of the auction organization have exclusive jurisdiction to hear any disputes.

Veilingreglement geldig in het jaar 2024.
Deze voorwaarden zijn geldig voor alle kopers en alle verkopers. De Nederlandstalige versie is bindend, alle vertalingen zijn louter informatief.
De koper en verkoper bevestigen door deel te nemen aan de veiling dat zij de veilingvoorwaarden geraadpleegd hebben, kennen en aanvaarden.
Dressage Horse Auction BV is organisator van life en online veilingen voor dressuur- en jumpingpaarden, in samenwerking met een notaris of deurwaarder die ondermeer zal toezien op het correcte verloop van de veilingen en de paarden zal toewijzen.
Bij life veilingen kan vanuit de zaal en op afstand geboden worden.
Bij online veilingen kan enkel online geboden worden.
De veilingen worden georganiseerd met behulp van de veilingwebsite www.dressagehorse.auction.
Kopers:
Kopers dienen zich vooraf aan te melden op de website en hun identiteit kenbaar te maken, alvorens zij online biedingen kunnen doen bij life of online veilingen.
Bij life biedingen in de roepzaal wordt de identiteit van de hoogste bieder nagegaan door de notaris of deurwaarder.
Verkopers:
De verkopers maken hun identiteit bekend bij het aanmelden van het paard.
De Veilingen:
Wij organiseren veilingen voor paarden in twee sportrichtingen, namelijk dressuur en jumping.
Om de leeftijd van een paard te bepalen wordt aanvaard dat elk paard op 1 januari een jaar ouder wordt, dus een paard geboren op 20 mei 2025 wordt op 1 januari 2026 één jaar.
De volgende paarden kunnen we opnemen in onze veilingen:
Veulens die minimum drie maand oud zijn bij aanvang van de biedingen, en gefokt zijn in de dressuur- of jumpingrichting.
Jonge paarden en paarden die tot de sportrichting dressuur of jumping behoren.
Die onze selectieprocedure doorstaan hebben.
Inschrijving en selectie:
Als veilingorganisatie maken we een selectie en beoordelen de paarden op basis van:
De selectie tot de veiling verloopt in vier fases. Door in te schrijven verbindt de verkoper er zich toe, het paard aan te bieden voor alle fases van de selectie, en daarna op de veiling, voor zover het paard na elke fase aanvaard blijft door de veilingorganisatie. De veilingorganisatie geeft nooit de reden waarom een paard niet geselecteerd wordt, ook niet aan de verkoper, ook niet aan derden.
-Inschrijving en eerste selectie:
Bij de inschrijving voor de selectie betaalt de verkoper 200 euro inschrijvingsgeld + BTW. De inschrijving is met kopie van het paspoort van het paard, de afstamming, de eigen prestaties, de prestaties aanverwanten, foto's en filmmateriaal, schofthoogte, de kleur, sportrichting, en alle nuttige informatie betreffende het paard.
De verkoper geeft het minimumbedrag voor verkoop op. Dit bedrag wordt niet gepubliceerd.
Tevens bezorgt de verkoper en zijn gegevens, kopie van zijn eigen identiteitsdocument, in voorkomend geval de gepubliceerde statuten van de vennootschap en het identiteitsdocument van de bestuurder.
De organisatie selecteert de eerste maal.
-Tweede beoordeling:
Na een eerste selectie op basis van de bij de inschrijving geleverde informatie geeft de veilingorganisatie de voorkeur bij de verkoper op afspraak ter plaatse te gaan om het paard te beoordelen. Dit kan op initiatief van de veilingorganisatie vervangen worden door foto en filmmateriaal door de verkoper aan te leveren. Een reden om niet ter plaatse te gaan kan de afstand tussen de veilingorganisatie en de verkoper zijn.
-Medische keuring:
Wanneer het paard tot dan een positief traject aflegt wordt de volledige medische keuring zoals gevraagd.
Een medische keuring met een verslag van maximum twee weken voor de inschrijving is een voorwaarde om kunnen deel te nemen aan de veiling.
Is het medisch verslag ouder, volstaat het de dierenarts te laten bevestigen dat de medische toestand onveranderd is gebleven. De dierenarts bevestigt met de datum en handtekening op het originele medische verslag.
Paarden jonger dan 2 jaar dienen enkel een door de dierenarts opgestelde gezondheidsverklaring voor te leggen, vanaf 2 jaar zijn er bijkomend 16 rx opnamen, waarbij de voorvoeten, de kogels, de sprongen en de knieën in beeld worden gebracht. De radiografieën dienen in het licht van het totale paard geïnterpreteerd te worden. Zowel het gebruiksdoel, de leeftijd, eventuele sportcarrière en de bevindingen tijdens het klinisch onderzoek zijn van belang.
De veilingorganisatie bepaalt welke paarden in de running voor de veilig blijven. Het volledige medische verslag is ter inzage tijdens de bezichtiging.
Van de aanvaarde paarden wordt door de verkoper foto's en filmmateriaal aangeleverd voor publicatie op de veilingwebsite. De veilingorganisatie mag zelf op elk moment foto’s en filmmateriaal maken voor gebruik op de website, en beslissen welk ze publiceert.
De aanvaarde paarden worden in de online catalogus opgenomen in een willekeurige volgorde.
Originele paspoort en andere noodzakelijke documenten:
-Bij de inschrijving en tijdens de selecties worden kopie van de documenten van het paard aanvaard.
-Voor aanvang van de life veiling moeten alle originele documenten op het secretariaat zijn. Het niet of niet tijdig bezorgen van de originelen staat gelijk met het paard niet aanbieden op de veiling.
-Bij online veilingen moeten de originele documenten getoond worden bij de voorstelling van het paard aan de afgevaardigde van de veilingorganisatie. Er worden kopie van de documenten overgemaakt. Alle originele documenten blijven bij het paard.
De wetgeving:
De wetgeving betreffende openbare veilingen is van toepassing. Dit houdt onder meer in:
De veiling verloopt onder leiding en/of toezicht van een notaris of deurwaarder.
De paarden zijn vooraf te bezichtigen. Bijgevolg wordt de koper geacht volledig, persoonlijk en onder eigen verantwoordelijkheid ingelicht te zijn over de staat van de paarden.
Het veilen van de paarden gebeurt in dezelfde volgorde als ze zijn opgenomen in de catalogus. De veilingmeester kan hiervan afwijken zonder een reden te moeten opgeven.
De biedingen verlopen bij opbod, met verhogingen zoals verder vermeld.
De notaris of deurwaarder wijst het paard toe aan het hoogste aanvaarde bod.
Bezichtiging:
De verkoper laat vooraf de paarden bezichtigen:
-Bij life veilingen startend vanaf 18 u of later:
in de stallen nabij de veilinghal op de dag van de veiling vanaf 14 uur tot twee uur voor aanvang van de veiling.
-Bij life veilingen startend om 15 u:
in de stallen nabij de veilinghal op de dag van de veiling vanaf 10 uur tot 13 uur.
-Bij online veilingen:
op het staladres gedurende twee opeenvolgende zaterdagen van 14 tot 18 uur. Tenzij anders vermeld de twee laatste zaterdagen voorafgaand aan de sluiting van de biedingen. Het staladres wordt op de website van de veilingorganisatie vermeld.
De verkoop:
De paarden worden ingezet voor een startbedrag in overleg met de verkoper gekozen door de veilingorganisatie.
Het startbedrag zal meestal tussen de helft en 2/3de van de verwachte verkoopprijs liggen. Het startbedrag is altijd een veelvoud van 500,00 euro.
Bij life veilingen:
Is er geen interesse voor het paard voor het startbedrag wordt in de eerste voorstelling niet verkocht.
Is in de eerste voorstelling het hoogste bod lager dan de verwachte verkoopprijs mag de verkoper beslissen het paard niet toe te wijzen, en dezelfde dag een tweede maal voorstellen na alle paarden een eerste maal voorgesteld zijn.
Wordt in de eerste voorstelling de verwachte verkoopprijs gehaald, kan het paard niet meer voorgesteld worden bij de tweede voorstelling.
Komt een paard in de tweede voorstelling wordt het startbedrag verlaagd naar 2/3de van het originele startbedrag, met als minimum een veelvoud van 500 euro. Het bieden in de tweede voorstelling kan nooit lager starten dan het hoogste bod in de eerste voorstelling.
Het is soms beter met een laag startbedrag te starten om de interesse voor het paard te wekken.
Bij online veilingen:
Is er tot 24 uur voor het sluiten van de biedingen geen interesse voor het paard wordt het startbedrag verlaagd naar 2/3de van het originele startbedrag, met als minimum 500 euro of een veelvoud ervan.
De biedingen:
De biedingen verhogen met de volgende bedragen per uitgebracht bod:
Het eerste bod is gelijk aan het startbedrag.
Tot 5.000 € is de verhoging 100 € per bod.
Vanaf 5.001 € is de verhoging 250 € per bod.
Vanaf 10.001 € is de verhoging 500 € per bod.
Vanaf 20.001 € is de verhoging 1.000 € per bod.
Vanaf 50.001 € is de verhoging 2.500 € per bod.
Vanaf 100.001 € is de verhoging 5.000 € per bod.
Boven 250.001 € is de verhoging 10.000 € per bod.
Bij life veilingen kan de veilingmeester hiervan afwijken en de verhoging terugbrengen naar een niveau lager.
De biedingen zijn altijd zonder BTW. Het bedrag van toewijzing is onderhevig aan de btw-regelgeving indien de verkoper BTW plichtig is.
Tot aan het sluiten van de biedingen blijft elke bieder gehouden door zijn bod en na het sluiten van de biedingen blijven de vijf hoogste bieders gebonden tot aan hetzij de toewijzing, hetzij de terugtrekking van het paard uit de veiling.
De vijf hoogste biedingen zijn bindend gedurende tien dagen na het sluiten van de biedingen. De toewijzing, hetzij de niet toewijzing van het paard vindt plaats binnen tien dagen. De verkoper behoudt het recht om al dan niet in te gaan op het bod. De toewijzing kan pas voltooid worden wanneer de verkoper de aangeboden prijs heeft aanvaardt, zowel bij een life veiling als een online veiling.
Bij life veilingen gebeurt het bieden door handopsteking.
De verkoper kan tot net voor het paard toegewezen wordt beslissen de verkoop niet te laten doorgaan, en het paard terugtrekken uit de veiling. Eens toegewezen is de verkoop definitief.
Tot aan het sluiten van de biedingen blijft elke bieder gehouden door zijn bod en na het sluiten van de biedingen blijven de vijf hoogste bieders gebonden tot aan, hetzij de toewijzing, hetzij het terugtrekken van het paard.
Bij online veilingen gebeuren de biedingen uitsluitend online via het aangeboden platform.
Indien er een bod wordt geplaatst in de laatste tien minuten voor het initieel vastgelegde einduur, dan wordt het einduur verlengd met tien minuten. Wanneer opnieuw een bod wordt uitgebracht in deze laatste tien minuten, zal de termijn, waarbinnen een bod kan worden uitgebracht, nogmaals worden verlengd met tien minuten. Dit proces zal ten laatste om middernacht aflopen.
Wie tijdens een openbare veiling een geldig bod doet wordt geacht dit bod te kunnen handhaven en de gevolgen van de koop te kunnen dragen.
De koper koopt de goederen zoals ze zijn, zonder garantie, zonder recht op herroeping of rouwkoop.
De verantwoordelijkheid gaat over op de koper bij het toewijzen, het genot bekomt de koper vanaf de levering.
De verwachte verkoopprijs:
De verkoper kan bij de aanmelding tot de selectie een verwachte verkoopprijs meedelen.
Deze verwachte verkoopprijs is van belang voor:
-De selectie en de verhandelbaarheid op onze veiling.
-Het al dan niet toewijzen op life veilingen.
-De eventuele commissie bij niet toewijzing.
Wanneer de verkoper geen verwachte verkoopprijs opgeeft wordt aanvaard dat elk ontvangen bod groter is dan de verwachte verkoopprijs.
Het toewijzen:
Enkel de notaris of deurwaarder kan een paard toewijzen. De veilingmeester kan de biedingen in ontvangst nemen, en voorlopig toewijzen.
Voor de toewijzing moet de notaris of deurwaarder de identiteit van de koper kunnen vaststellen. De veilingorganisatie, de notaris of deurwaarder kunnen daarom altijd een kopie van het identiteitsdocument van elke bieder opvragen.
De notaris of deurwaarder kan in het kader van een verkoop personen weigeren die hem onbekend zijn of van wie de identiteit of de gegoedheid niet is bewezen, of de persoon niet solvabel is. De notaris of deurwaarder kan biedingen weigeren van mensen die klaarblijkelijk onder invloed zijn van alcohol, drugs, of andere narcotica. De notaris of deurwaarder kan dan terugvallen op de een na hoogste bieder. Bij de weigering van een bod door de notaris of deurwaarder moet hij hiervan geen gemotiveerd proces-verbaal opstellen.
Het paard wordt toegewezen aan het hoogste aanvaarde bod wanneer de verkoper de aangeboden prijs heeft aanvaard.
De notaris of deurwaarder stelt de akte van toewijzing op, en ondertekent deze.
-Bij een life veiling:
wijst de notaris of deurwaarder na het aflopen van de biedingen toe aan het hoogste aanvaarde bod, na aanvaarding van het bod door de verkoper.
Bij aanwezigheid van de verkoper aanvaard hij onmiddellijk het hoogste aanvaardbare bod, of wijst hij het af.
Bij afwezigheid geeft de verkoper aan de organisatie de volmacht om in zijn naam het bod te aanvaarden wanneer de verwachte verkoopprijs behaald is. Wordt de verwachte verkoopprijs niet behaald, geeft hij aan de organisatie de volmacht om in naam van de verkoper het bod niet te aanvaarden.
Tot 72 uur na het sluiten van de biedingen kan de verkoper aan de veilingorganisatie per email aan info@dressagehorse.auction of aan info@jumpinghorse.auction laten weten dat hij NIET instemt met de verkoop aan het hoogste bod. Wanneer hij niet of niet tijdig meldt dat hij niet instemt met de verkoop wordt hij geacht met de verkoop in te stemmen.
De commissie:
Wordt een paard niet toegewezen voor de verwachte verkoopprijs is de verkoper geen commissie verschuldigd.
Indien het hoogste bod gelijk is aan de verwachte verkoopprijs of hoger geboden is en de verkoper het paard toch niet laat toewijzen is de verkoper een schadevergoeding verschuldigd gelijk aan de commissie die hijzelf normaal zou verschuldigd geweest zijn, verhoogd met het bedrag dat de koper normaal zou betaald hebben aan veilingkosten.
Het inschrijvingsgeld, de commissie, de veilingkosten en de schadevergoeding zijn verschuldigd aan de organisatie. Deze bedragen zijn onderhevig aan de btw regelgeving.
De verkoper staat volgende commissie af aan de veilingorganisatie, te rekenen op het bedrag van toewijzing:
-4% commissie bij life veilingen,
-2% bij online veilingen.
De commissie is onderhevig aan de btw regelgeving.
De koper betaalt 10% veilingkosten op het bedrag van toewijzing.
De veilingkosten zijn onderhevig aan de btw regelgeving.

De veilingorganisatie mag aan schuldvergelijking doen, en alzo het saldo tussen de vordering en de schuld afrekenen.
De veilingorganisatie neemt de gelden in ontvangst zonder hiervoor kosten te rekenen of intresten te betalen.
Varia:
Bij onduidelijkheid of onenigheid voor, tijdens of na een veiling, van welke aard ook, ongeacht welke partijen, zal aan de notaris of deurwaarder gevraagd worden een beslissing te nemen als onafhankelijk persoon. Deze beslissing is definitief.
Vanaf de toewijzing van het paard tot het ophalen draagt de verkoper zorg voor het paard als een goed huisvader.
Alle biedingen en betalingen gebeuren in Euro. Alle geldelijke bedragen, zowel van de koper als de verkoper, zijn onmiddellijk verschuldigd bij toewijzing, of bij het terugtrekken uit de veiling of de verkoop.
Op de afrekening zal steeds BTW in rekening gebracht worden, behalve op het bedrag van toewijzing als de verkoper niet BTW-plichtig is. In geval van export is dit een voorlopige aanrekening tot zekerheid van dit bedrag. In geval van export van het paard zal de koper binnen 14 dagen na de levering bij de organisatie een geldig exportdocument voorleggen op straffe van het definitief in rekening brengen van de BTW.
Noch de verkoper, noch de koper kunnen enig recht ontlenen aan het feit dat de veilingorganisatie de paarden heeft geselecteerd en desgevallend op haar verzoek aan een veterinair onderzoek onderworpen werden.
De informatie betreffende de paarden is enkel bedoeld een indruk te geven over de kwaliteiten van de paarden, zonder de pretentie volledig te zijn en zonder daarmee garanties te geven. De organisatie is bij de omschrijving van het paard afhankelijk van de door een verkoper of derden verstrekte informatie. De organisatie is niet aansprakelijk voor gebeurlijke drukfouten en/of materiële vergissingen op haar website, online en gedrukte catalogus.
De organisatie is geen partij bij de koop-/verkooprelatie van geveilde paarden. De organisatie treedt enkel op als veilingdienst tussen verkoper en de koper van het paard. Het organiseren, de voorbereiding en de uitvoering van de veiling worden uitsluitend door de organisatie bepaald. Dit betekent onder andere dat de organisatie de gang van zaken voorafgaand aan en tijdens de veiling bepaalt en de bevoegdheid heeft om, één of meer paarden niet te veilen of, een bod niet te erkennen en ongeldig te verklaren, de veiling te schorsen, te hervatten, te verlengen of af te gelasten en/of andere naar haar oordeel noodzakelijke maatregelen te nemen.
De facturatie die via de organisatie loopt geeft geen aanleiding om partij te zijn in het verkoop- en aankoopproces.
De betaling door de koper moet in alle gevallen toekomen op de rekening van de organisatie, tenzij aangegeven is dat de gelden moeten toekomen op de derdenrekening van de opvolgende notaris (of deurwaarder). De betalingen moeten ten laatste toekomen tien dagen na de toewijzing. Bij laattijdige betaling rekent de organisatie 25 euro per dag vertraging aan, met een minimum van 500 euro plus 21% BTW.
Op vraag van de verkoper is de notaris of deurwaarder in samenspraak met de veilingorganisatie gemachtigd een verkoop teniet te doen.

De veilingkosten blijven door de koper verschuldigd.
De commissie blijft door de verkoper verschuldigd.
Het tenietdoen van een verkoop / koop wordt door de betrokken notaris of deurwaarder vastgesteld in een bijkomend proces verbaal.
Wanneer binnen de gestelde termijn de betaling niet ontvangen is op de aangeduide rekening is de verkoper vrij om een procedure tot invordering te starten tegenover de koper. De kosten verbonden aan de invorderingsprocedure worden voorgeschoten door de verkoper en komen integraal ten laste van de koper.
Het deelnemen aan de selecties en de veiling zijn volledig op verantwoordelijkheid van de verkoper. Hij verklaart voor schade aan derden een aansprakelijkheidsverzekering afgesloten te hebben.
In geval van schade waarbij de aansprakelijkheid de veilingorganisatie betrokken kan zijn, van welke aard dan ook, zal de koper en de verkoper in elk geval de veilingorganisatie vrijwaren voor alle schade met een bedrag hoger dan het inschrijvingsgeld.
Dierengezondheid:
-De plaats van de life veiling valt binnen een schutzone in verband met de dierengezondheid waardoor er geen verzamelingen en / of transporten van paarden mogelijk of toegelaten zijn.
-Gezondheidscertificaat:

Enkel wanneer het bedrijf van de verkoper binnen een schutkring valt waardoor er geen paardentransport naar de veiling mogelijk is, wordt het aanzien als overmacht en is de verkoper geen schadevergoeding verschuldigd.

Dierenwelzijn:
De verkoper en koper schikken zich naar de wetgeving betreffende het dierenwelzijn.
De levering van het paard:
De koper haalt bij de verkoper het paard op binnen 14 dagen na de toewijzing, nadat hij de volledige betaling gedaan heeft op de rekening van de veilingorganisatie (of de derdenrekening van de opvolgende notaris of deurwaarder indien deze vermeld is).
De organisatie verwittigt de koper en de verkoper dat de betaling is binnengekomen en het paard kan opgehaald worden.
De koper bepaalt in samenspraak met de verkoper de dag en het uur dat hij het paard zal ophalen.
Indien het paard tijdens deze 14 dagen niet opgehaald wordt mag de verkoper aan de koper een stalgeld van 25 € per dag aanrekenen vanaf de 15de dag na de toewijzing. Deze afrekening gebeurt rechtstreeks tussen de verkoper en de koper.
Veulens blijven in principe bij de moeder tot ze vijf maanden oud zijn. Is een veulen op de dag van de toewijzing jonger dan vijf maanden, neemt de periode voor ophalen aanvang op de dag dat het veulen de leeftijd van vijf maanden bereikt. De koper kan beslissen het veulen op jongere leeftijd op te halen al mag het veulen bij het ophalen niet jonger zijn dan vier maanden.
Voorwaarden enkel geldig bij een gedwongen openbare verkoop:
De voorwaarden geldig voor deze vorm van openbare verkoop worden bekend gemaakt bij het openbaar maken van de veiling.
Zo kunnen de paarden worden verkocht zonder medische keuring.
De gegevens op de aanplakbiljetten, in de aankondigingen en op de verkoopwebsite zijn louter informatief. De paarden waren te bezichtigen. Bijgevolg wordt de koper geacht volledig, persoonlijk en onder eigen verantwoordelijkheid ingelicht te zijn over de staat van de paarden.
De deurwaarder zal de veiling opvolgen, bijstaan, en de dieren toewijzen.
De vergoeding van Dressage Horse Auction wordt vooraf vastgelegd in een contract met de verkopende deurwaarder.
Algemeenheden:
Elk geschil voortvloeiende uit deze veiling en haar gevolgen wordt uitsluitend beheerst door de Belgische wet met uitsluiting van de bepalingen van het Weens Koopverdrag inzake internationale koop-verkoop. In het bijzonder is de wetgeving op openbare veilingen van toepassing, ook wat betreft het consumentenrecht.
Bij onduidelijkheid of onenigheid voor, tijdens of na een veiling, van welke aard ook, ongeacht welke partijen, zullen de betrokken partijen aan de notaris of deurwaarder vragen een beslissing te nemen als onafhankelijk persoon. De beslissing genomen door de notaris / deurwaarder is definitief en bindend voor de getrokken partijen.
De rechtbanken die bevoegd zijn op de plaats van de maatschappelijke zetel van de veilingorganisatie zijn exclusief bevoegd om kennis te nemen van gebeurlijke geschillen.
